On October 9, 2018, New York State required every employer within the state to provide employees with annual sexual harassment prevention training. An employer that does not use the model training developed by the Department of Labor and Division of Human Rights must ensure that the training they use meets or exceeds the minimum standards set forth by NYS.

It is important to note that there is no requirement to train independent contractors, third-party vendors or other non-employees who are regularly on the business owner's premises. In other words, if you have booth renters or 1099 contractors, you do not have to provide this training. However, the state does recommend posting a copy of your policy in an area that is highly visible to further communicate your effort as a responsible employer.
